To Manufacture, Process, Acquire, Distribute, Store, Keep, Transport or Carry Drugs
“A person who without due permit manufactures, processes, acquires, distributes, stores, keeps, transports or carries narcotic drugs or analogues thereof, shall be punished, for high risk narcotic drugs – by imprisonment of ten to fifteen years and a fine, and for risk narcotic drugs – by imprisonment of three to fifteen years.” (Bulgarian Penal Code, Article 354а)
Who carries narcotic drugs or analogues without due permit over the state border shall be punished by imprisonment of ten to fifteen years and a fine. A person who carries precursors or facilities and materials for manufacture of narcotic drugs without a due permit over the state border is liable to two to ten years’ imprisonment and a fine. If the amount smuggled under the above-mentioned paragraphs is especially large, the punishment is 15-20 years’ imprisonment.
“A person who forms, leads or takes part in a group made up for the purpose of committing crimes in this country or abroad, shall be punished by imprisonment of one to five years (...) Where such group has been organized or armed or formed for the purpose of illicit trafficking of narcotic drugs, analogues or precursors, or where an official takes part in such a group,” the punishment is 3-10 years’ imprisonment for participants and 5-15 years’ imprisonment for leaders.(Bulgarian Penal Code, Art. 321)
Where objects of the crime are precursors or facilities and materials for manufacture of narcotic drugs, the punishment is lighter - imprisonment of three to fifteen years and a fine. The section provides for a number of aggravating circumstances, for example, if the crime has as its object substances of particularly large quantities, or has been committed by two or more persons who have conspired in advance, etc.
